Asia Bibi acquitted in blasphemy case

ISLAMABAD: The Supreme Court on Wednesday acquitted Asia Bibi of blasphemy charges, declaring the death penalty handed down to her by a trial court null and void.

The verdict on her final appeal against her execution was reserved by a special three-member bench on October 8.

The bench ruled that Asia Bibi be released if she is not facing anymore charges.

Following the announcement, protests erupted in various cities against the judgement.

The verdict was announced by a special bench headed by Chief Justice Mian Saqib Nisar at 9am. Justice Asif Saeed Khosa and Justice Mazhar Alam Khan Miankhel were the other members of the bench.

The 56-page order, authored by CJP Nisar also has an additional note of Justice Asif Saeed Khosa.

Accepting the plea of the accused, the order read: “It is a well settled principle of law that one who makes an assertion has to prove it. Thus, the onus rests on the prosecution to prove guilt of the accused beyond reasonable doubt throughout the trial.

“Presumption of innocence remains throughout the case until such time the prosecution on the evidence satisfies the Court beyond reasonable doubt that the accused is guilty of the offence alleged against him. There cannot be a fair trial, which is itself the primary purpose of criminal jurisprudence, if the judges have not been able to clearly elucidate the rudimentary concept of standard of proof that prosecution must meet in order to obtain a conviction. Two concepts i.e., “proof beyond reasonable doubt” and “presumption of innocence” are so closely linked together that the same must be presented as one unit. If the presumption of innocence is a golden thread to criminal jurisprudence, then proof beyond reasonable doubt is silver, and these two threads are forever intertwined in the fabric of criminal justice system. As such, the expression “proof beyond reasonable doubt” is of fundamental importance to the criminal justice: it is one of the principles which seeks to ensure that no innocent person is convicted. Where there is any doubt in the prosecution story, benefit should be given to the accused, which is quite consistent with the safe administration of criminal justice.

Further, suspicion howsoever grave or strong can never be a proper substitute for the standard of proof required in a criminal case, i.e. beyond reasonable doubt. In the presence of enmity between the accused and the complainant/witnesses, usually a strict standard of proof is applied for determining the innocence or guilt of the accused. If the PWs are found inimical towards the accused, she deserves acquittal on the principle of the benefit of the doubt. Keeping in mind the evidence produced by the prosecution against the alleged blasphemy committed by the appellant, the prosecution has categorically failed to prove its case beyond reasonable doubt. Reliance in this behalf may be made to the cases reported as Muhammad Ashraf Vs. The State (2016 SCMR 1617), Muhammad Jamshaid Vs. The State (2016 SCMR 1019), Muhammad Asghar alias Nannah Vs. The State (2010 SCMR 1706), Noor Muhammad alias Noora Vs. The State (1992 SCMR 2079) and Ayub Masih Vs. The State (PLD 2002 SC 1048).”

While reserving the verdict after hearing, the top court had restrained both electronic and print media from discussing or commenting on the matter till the final judgement.

Asia Bibi, a Christian accused of blasphemy eight years ago, was awarded death sentence over blasphemy charges.

A case was filed against her by a prayer leader in Katanwala village of Nankana Sahib.

The prayer leader said Asia had confessed to committing blasphemy during an argument with a Muslim woman over a bowl of water. She was convicted and sentenced to death in 2010 and has been in jail ever since

Youth role in eradication of terrorism, extremism sought

Staff Report

Lahore/Islamabad

Speakers at a seminar here on Tuesday stressed that reasoning and debate is the right way to convince others as enforcement of beliefs through force or coercion has very serious consequences for peace and tranquility in a society. ‘Roots of extremism and militancy lie in intolerance and not listening to others’ point of view, which wipe out moderation and foster extremism in a society,’ said Tanzeem-ul-Madaris Vice President Allama Raghib Naeemi while addressing a Paigham-e-Pakistan conference here at Data Darbar.
He said emphasis must be laid on inclusive citizenship as all citizens, whether Muslims or non-Muslims, enjoy equal rights in Pakistan. ‘Declaring anyone infidel by an individual is against the teachings of Islam. It is very dangerous approach and the Muslim Ummah should play its role to counter such trends,’ he said, adding that punishing anyone for any wrongdoings is the purview of the state and the judiciary. ‘Individuals must not take law into hand for punishing the sinners or wrongdoers,’ he added.
Raghib Naeemi said Islam preaches peace and harmony and gives very clear message of the respect of humanity. ‘Saints and Sufis have always propagated love and brotherhood … there is no place for terrorism, extremism, intolerance and narrow mindedness in Islam,’ he said, adding that Ulema, Mashaikh, scholars and intellectuals need to play there role to save the society from devastation. At a separate event organized by the Islamic Research Institute (IRI) at the Faisal Mosque Campus Islamabad, speakers stressed the need to raise awareness among students and youth as to how they can play their role in eradicating the menaces of terrorism and extremism from the society.
Addressing on the occasion Council of Islamic Ideology Chairman Dr Qibla Ayaz highlighted the importance of education for achieving durable peace and prosperity in the country. He said the younger generation had the key role in national development as the youth wanted peace in tranquility in the society. He underlined the need for eliminating extremism and terrorism and achieving lasting peace through education and creating awareness among public, especially youth, for progress and prosperity. IRI Director General Dr Zia ul Haq said bright future of the country was linked with the youth.
He said only education can bring peace in society, and urged the teachers to lay focus on character-building of students to effectively deal with the tendencies of extremism and violence. ‘A large part of the community is suffering from mutual hatred, ethnocentric mindset, intolerance, extremism and terrorism. Paigham-e-Pakistan initiative will help eradicate terrorism and prove instrumental in reforming the youth who have lost their path due to negative propaganda by some aberrant elements,’ he said.
International Islamic University Islamabad President Dr Ahmed Yousuf Al Darwish called for promoting a culture of accommodation, tolerance and harmony across all kinds of divides. ‘We need to build bridges of cooperation, positive interaction, dialogue and mutual sharing rather than barriers and walls that divide us and cause mutual distrust and conflict. Religious and cultural extremism and terrorism adversely affects the society and it loses the societal feature of cultural and religious tolerance and political accommodation,’ he said, adding that academicians and intellectuals have a leading role in inculcating the values of pluralism, brotherhood and tolerance in society, especially the youth. The basic objective of the activity was to sensitize the students and the youth about the horrific dangers and risks associated with the wave of terrorism and extremism and train them vis-à-vis ways and methods to safeguard the community from these threats.

Supreme Court acquits Asia Bibi facing death sentence for blasphemy

F.P. Report

ISLAMABAD: The Supreme Court of Pakistan has acquitted Asia Bibi, a Pakistani Christian who was facing death sentence for blasphemy, on Wednesday.

Chief Justice of Pakistan Mian Saqib Nisar headed a three-judge special bench. Justice Asif Saeed Khosa and Justice Mazhar Alam Khan Miankhel were included in the bench. The bench announced the verdict on the final appeal filed by the convict.

The apex court ordered to release the Christian woman, who was in jail for past nine years, if he was not nominated any other case.

The court had reserved his verdict over the appeal on Oct 8.

The allegations against Bibi date back to June 2009, when she was laboring in a field and a row broke out with some Muslim women who alleged that she committed blasphemy against Prophet Muhammad (Peace Be Upon Him). A case was filed against her by a prayer leader in Katanwala village of Nankana Sahib.

Bibi was convicted of blasphemy and sentenced to death in 2010.

In Islamabad, Red Zone has been sealed due to security concerns. The road from Rawal Dam roundabout to Red Zone has also been blocked by placing containers.

Meanwhile, the security has also been beefed up in all areas with minority population, and places of worship.

Heavy contingent has also been deployed at the apex court and other courts.

Tehreek-e-Labbaik Pakistan (TLP) and other religious parties have also arranged gatherings in different areas of Pakistan to hear the verdict of the Supreme Court.

BP profits double on stronger oil prices

LONDON (BBC): Profits at oil giant BP more than doubled in the third quarter, boosted by stronger oil prices and higher production from new oil fields.

Profits rose to $3.8bn (£3bn) from $1.86bn a year earlier, its best quarterly result for five years.

Revenue in the July-to-September quarter jumped to $80.8bn, up from $60.8bn last year.

Over the past three months, the price of Brent crude oil has averaged $75.07 a barrel, up 44% from a year earlier.

The Brent price reached a four-year high of more than $86 a barrel earlier this month before dropping back to around $77.

BP’s profits were ahead of analysts’ expectations, and shares in the company were up 3.9% in early trade on the London Stock Exchange.

BP chief executive Bob Dudley said: “Operations are running well across BP and we’re bringing new, higher-margin barrels into production faster through efficient project execution.”

Richard Hunter, head of markets at Interactive Investor, said: “BP has set the bar high for the oil majors in general, delivering a blockbuster set of earnings which have comfortably outpaced expectations.

“These numbers reflect a business which is back on its game.”

Five major BP projects have come on stream in 2018 in the Gulf of Mexico, Australia, Azerbaijan, Russia, and Egypt.

The company said it expected production to grow further in the next three months thanks to the shale oil and gas fields it bought from the Anglo-Australian miner BHP for $10.5bn. The sale is expected to completed on Wednesday.

It now says it will pay for the acquisition out of cash if oil prices stay high rather than through selling shares.

BP chief financial officer Brian Gilvary said: “Since we announced the BHP transaction, oil prices have firmed to levels significantly above the acquisition assumptions. While oil prices remain at these levels, we expect to finance the transaction fully using cash.”

However, the company is still paying for its disastrous oil spill in the Gulf of Mexico in 2010 and set aside another $500m to cover the damage from the accident.

BP paid a dividend of 10.25 cents a share for the third quarter, 2.5% higher than a year earlier.

Gold slips as escalating trade war tensions boost dollar

WASHINGTON (Reuters): Gold slid on Tuesday as the dollar benefited from concerns about an escalating trade dispute between the United States and China, leaving the metal near key technical levels that might prompt fresh speculative bets for prices to fall further.

Spot gold was down 0.6 percent to $1,222.05 an ounce at 1017 GMT, having earlier touched it lowest in a week. U.S. gold futures were 0.3-percent lower at $1,223.70 an ounce.

The dollar rose towards 2-1/2 month highs versus a basket of other major currencies after Bloomberg reported Washington was preparing to announce tariffs on all remaining Chinese imports by early December if talks next month between U.S. President Donald Trump and Chinese President Xi Jinping fail to ease the trade war.

“The dollar’s appreciation is not helping gold and the general movement down appears to be related to increased speculation about further moves by the Trump administration in relation to tariffs,” said Capital Economics analyst Ross Strachan.

Gold prices have slipped around 10 percent from their April peak after investors turned to the dollar as a safe-haven, as the U.S.-China trade war unfolded against a background of higher U.S. interest rates.

On the technical front, gold was testing support at the 100-day moving average around $1,220.

“If we drop back below the 100-day moving average, speculators could be inclined to add short positions again after they slashed them massively in the last 2-3 trading weeks. There could be risk that we could drop towards $1,200 again,” said Commerzbank analyst Carsten Fritsch.

Also hurting bullion was a modest recovery in global stock markets, analysts said.

“We will see gold trend around this ($1,220-$1,230) range for some time, unless some major breakthrough takes place politically or in the financial/economic space,” said John Sharma, an economist with National Australia Bank (NAB).

Gold prices have gained about 3 percent this month and are on track to break a six-month losing streak, the longest since a downturn that ran from the start of August 1996 to the end of January 1997.

Investors’ inclination towards gold can be seen in the holdings of the largest gold-backed exchange-traded-fund (ETF), New York’s SPDR Gold Trust, which rose to their highest in nearly two months, at 24.27 million ounces, on Monday.

In other precious metals, silver was down 0.2 percent at $14.42 per ounce, after hitting a near three-week low of $14.37 earlier.

Platinum was steady at $832 per ounce and palladium was down 0.1 percent at $1,087.90 per ounce.

Court to record Nawaz’s statement in next Al-Azizia hearing

ISLAMABAD : The accountability court hearing the Al-Azizia corruption reference against Nawaz Sharif on Tuesday ordered the prosecution to record the former prime minister’s statement during the next hearing.

Prosecutor of National Accountability Bureau (NAB) Wasiq Malik informed the court that the watchdog has completed presenting its evidence against the accused in the reference.

A total of 22 witnesses were produced before the accountability court since October last year, following Nawaz’s indictment in the Al-Azizia/Hill Metal Establishment reference.

Copies of the Supreme Court’s verdicts dated April 20 and July 28 have also been submitted in the court, the prosecutor informed.

Khawaja Haris, Nawaz’s lead defence counsel, objected to the prosecutor’s remarks stating that the April 20 verdict was not related to Al-Azizia reference. An older verdict was no longer relevant after another verdict was announced by the apex court, he contended.

It is worth noting that the accountability court has until November 17 to wrap up the remaining two corruption references – Al-Azizia and Flagship Investments – against the Sharif family. The Supreme Court had granted final extension to the court earlier this month, after its deadline to conclude the trials against the Sharifs had ended on October 7.

HR abuses in Occupied Kashmir blot on humanity’s conscience: Lodhi

WASHINGTON : Pakistan told the United Nations that the ongoing violations of human rights in Indian Occupied Kashmir are a blot on the conscience of humanity, and demand immediate corrective action from the international community.

Speaking in the Third Committee of the General Assembly on Promotion and Protection of Human Rights, Pakistan’s Ambassador to the UN Dr Maleeha Lodhi said that India’s consistent denial of the Kashmiris’ right to self-determination was “a telling example” of Indian impunity.

Ambassador Lodhi said that the latest report of the UN High Commissioner for Human Rights had “lifted the veil from decades of obfuscation by India of massive human rights violations in Jammu and Kashmir”.

She said that when the Kashmiri people demand the right of self-determination promised to them by several Security Council resolutions, they are met with oppression and ruthless human rights abuses at the hands of Indian occupying forces.

The envoy reaffirmed Pakistan’s strong support for the OIC resolution on combating intolerance and negative stereotyping in the context of interfaith harmony. Pakistan will continue to support an equitable, just and fair order, both at home and globally, she noted.

Lodhi added that Pakistan will continue its efforts to choose dialogue over division, harmony over intolerance and right over might.

She further called for strengthening safeguards against new and contemporary manifestations of discrimination, xenophobia and Islamophobia.

PM Imran’s China visit to usher in new era of bilateral ties: Beijing

BEIJING : The Chinese foreign ministry has said Prime Minister Imran Khan’s upcoming visit to Beijing presents important opportunities for leaders of the two sides to “chart the course for the future development of bilateral relations under new circumstances”.

Prime Minister Imran Khan will pay an official visit to China from November 2 on the invitation of his Chinese counterpart Li Keqiang and President Xi Jinping.

Addressing his regular press briefing in Beijing, Chinese foreign ministry spokesperson Lu Kang said, “During his visit, President Xi Jinping, Premier Li Keqiang and other Chinese leaders will meet and hold talks with him.”

“The two sides will have an in-depth exchange of views on bilateral relations and issues of mutual interest,” he added.

The spokesperson further said that PM Imran will also attend the first China International Import Expo in Shanghai.

Lu Kang expressed confidence that bilateral relations between China and Pakistan would not be affected by changes in the international and domestic situations. “I would like to stress again that China and Pakistan are all-weather strategic partners for cooperation. Our friendship goes back so long and our political mutual trust enjoys such a solid foundation that China-Pakistan relations are immune to the changing international and domestic landscapes,” he said.

Yuan hit 10-year low on fresh Sino-U.S. trade worries

SINGAPORE (Agencies): The dollar held most of its overnight gains against a basket of its key rivals, with Tuesday’s trade supported by a safe haven bid as fresh worries over Sino-U.S. frictions and fears of a slowdown in global economic growth sapped investors’ confidence.

Investors took cover in the greenback after Bloomberg reported that Washington is preparing to announce tariffs on all remaining Chinese imports by early December if talks next month between U.S. President Donald Trump and Chinese President Xi Jinping fail to ease the trade war.

Trump and his Chinese counterpart are due to meet on the sidelines of the Group of 20 leaders’ summit in Argentina at the end of November.

In Asia, stocks got off to a tentative start and managed to steady as policymakers in China announced further steps to restore confidence in local markets that have seen steep declines recently. That boosted Chinese equities and tempered some of the gloom around Beijing’s bitter trade fight with Washington.

The Chinese yuan currency was hovering at 10-year lows in onshore trade, giving up 0.1 percent to 6.9696 per dollar, stirring speculation over whether the central bank will tolerate a slide beyond the key level of 7 per dollar.

Policy insiders said on Friday that China is likely to use its vast currency reserves to stop any precipitous fall through the psychologically important 7 level as it could risk triggering speculation and heavy capital outflows.

The Japanese yen, also a safe haven currency sought during times of market stress, extended its losses versus the dollar after losing ground overnight, partly as Japanese investors have been net buyers of offshore equities in the current month.

Yen traders are also focused on the central bank’s monetary policy meeting due Wednesday.

The dollar index, a gauge of the currency’s strength against six major peers, traded at 96.66, up 0.1 percent on Tuesday. It hit a 2018 high of 96.86 on Aug. 15.

The Australian dollar, often viewed as a barometer of global risk appetite, put on 0.43 percent at $0.7085 on Tuesday, buoyed by the rally in Chinese equities.

China is Australia’s largest trading partner, and economic news from the Asian giant tends to influence Australian asset markets.

Elsewhere, the euro. remained under the gun due to continued political uncertainty. The single currency managed to hold steady against the dollar at $1.1377, having hit a 10-week low of $1.1332 on Monday on news that German Chancellor Angela Merkel would not seek re-election as head of her Christian Democrats (CDU) party.

The euro has also been weighed by the ongoing standoff between Brussels and Rome over Italy’s free-spending budget that would breach the European Union’s fiscal rules.

Al-Azizia reference: Nawaz Sharif to record statement during next hearing

F.P. Report

ISLAMABAD: Former prime minister Nawaz Sharif will record his statement during the next hearing of Al-Azizia reference after the accountability court on Tuesday ordered the prosecution to record the Sharif’s statement.

During the hearing, the NAB, prosecutor Wasiq Malik told the court that the bureau has completed presenting its evidence against the accused in the reference.

A total of 22 witnesses were produced before the accountability court since October last year, following Nawaz’s indictment in the Al-Azizia/Hill Metal Establishment reference.

Copies of the Supreme Court’s verdicts dated April 20 and July 28 have also been submitted in the court.

Nawaz’s counsel, Khawaja Haris objected the prosecutor’s remarks stating that the April 20 verdict was not related to Al-Azizia reference. An older verdict was no longer relevant after another verdict was announced by the apex court.

Nawaz and his sons, Hussain and Hasan, are accused in all three references whereas Maryam and Safdar were accused in the Avenfield reference only.
