Chief Justice of the Islamabad High Court (IHC) Athar Minallah has dismissed the petition filed by US blogger Cynthia Richie against the court order for non-compliance on merit.
Islam High Court Chief Justice Athar Minallah had reserved judgment after hearing the petition of Cynthia de Richie.
During the hearing, Cynthia’s lawyer Imran Feroze Malik read out the decision of the Additional Sessions Judge, then Chief Justice Athar Minallah remarked, “How are you affected by this decision?” This is not an order to register a case directly, the court has ordered the FIA to investigate first.
Petitioner’s counsel said that we do not object to the inquiry, only to the part of the case registration. The Chief Justice said that the court would not go into the merits of this case.
Following the hearing, the court issued a written order stating that under Article 199 of the Constitution, the court does not interfere in matters relating to inquiries or investigations and therefore the FIA has the power to conduct inquiries.
The decision states that the FIA, after reviewing the material collected during the inquiry, will form an opinion on whether a case can be registered under the PICA Act.
